Please read this entire agreement carefully. By checking the box indicating acceptance, you are entering into a legally binding contract with Putter Sim Lounge Inc. (“PSL,” “we,” “us,” “our”) and are waiving certain legal rights, including the right to sue. If you do not understand or agree with any part of this agreement, do not check the box and do not book, enter, or use the facility.

1. Who This Agreement Covers

This agreement applies to you, every person you bring to the facility (your “Guests”), and any person playing under your booking, whether or not they are your Guests. You are responsible for ensuring every person in your bay has read and agreed to this document before using the facility.

Minors: Persons under 18 must be accompanied at all times by a parent or legal guardian who has agreed to this document on the minor’s behalf. Unaccompanied minors are not permitted in the facility under any circumstances.

2. Nature of the Activity and Inherent Risks

Putter Sim Lounge is an unmanned, self-access indoor golf simulator facility located at 8201 Weston Road, Unit 2, Woodbridge, Ontario. The facility is open for booked sessions daily from 6:00 AM to 12:00 AM (midnight). You acknowledge and agree that participation in golf simulator activities, putting green activities, and use of the facility involves inherent risks, including but not limited to:

  • Striking of golf balls at high velocity, causing injury to self or others from errant shots, ricochets, or rebounds from screens, walls, ceilings, or equipment.
  • Injuries caused by golf clubs, including contact with other persons, equipment, or surfaces during swings, practice swings, or handling.
  • Slips, trips, or falls on turf, putting surfaces, floors, or during entry and exit from the bay.
  • Strain, sprain, pulled muscles, back injuries, joint injuries, eye injuries, or other physical injuries from the physical activity of golf.
  • Injuries or property damage from equipment failure, projector or screen malfunction, or technology errors in the simulator hardware or software.
  • Exposure to other facility users, equipment left by other users, or conditions caused by other users when the facility is unmanned.
  • Electrical, fire, or environmental hazards that may exist in any physical facility.
  • Medical emergencies occurring while no staff are present on site.
  • Emotional, psychological, or mental stress related to the activity.
  • Other risks, known or unknown, that may arise from use of a golf simulator facility.

You acknowledge that no staff member is present on site at any time and that you are responsible for your own safety and the safety of your Guests during your booked time.

3. Assumption of Risk

You voluntarily and freely assume all risks associated with your use of the facility, whether those risks are foreseeable or unforeseeable, known or unknown. You understand that injury, property damage, or even death could result from your activities at PSL, and you accept full responsibility for these risks.

4. Release and Waiver of Liability

In consideration of being permitted to use Putter Sim Lounge’s facility, you, on behalf of yourself, your heirs, executors, administrators, and assigns, RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Putter Sim Lounge Inc., its owners, directors, officers, shareholders, employees, contractors, agents, landlords, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, costs, damages, or liabilities of any kind arising from or related to:

  • (a) your use of the facility, equipment, or services;
  • (b) any injury, illness, death, loss, or property damage suffered by you or your Guests, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law;
  • (c) any acts or omissions of other facility users or third parties;
  • (d) any malfunction, defect, or failure of simulator equipment, access control systems, or other facility infrastructure;
  • (e) the unmanned nature of the facility and the absence of on-site staff.

This release applies whether the claim arises in contract, tort (including negligence), strict liability, or otherwise, to the maximum extent permitted by Ontario law.

5. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your conduct or your Guests’ conduct at the facility, or from any breach of this agreement by you.

6. Rules of the Facility

You agree to comply with all posted rules, as well as the following:

Operating Hours

  • The facility is available for booked sessions daily from 6:00 AM to 12:00 AM (midnight). Entry outside your booked time is not permitted.
  • Bookings cannot extend beyond 12:00 AM. All guests must exit the facility by midnight.

Access and Entry

  • Entry is granted only through the PSL access code sent to you for your booked time. Do not share your code with anyone not accompanying you.
  • Do not allow anyone to enter on your booking who has not also agreed to this document.
  • Do not prop doors open or allow unknown persons to enter behind you.
  • Leave promptly at the end of your booked time so the next customer can access their bay.

Conduct and Safety

  • Only one person may swing a club at a time in the bay. All other persons must stand clear of the hitting area.
  • Never swing a club outside of your designated bay area or near other people.
  • Do not climb on, lean against, or touch the projector, screen, launch monitor, or any simulator equipment except as needed for normal play.
  • Do not enter another person’s bay during their booked time.
  • Children must be supervised at all times and are not permitted to swing clubs without direct adult supervision.
  • No running, horseplay, or rough behavior inside the facility.
  • Footwear appropriate for indoor use must be worn at all times. No metal spikes, cleats, or outdoor-only shoes on the hitting surface or putting green.

Alcohol, Smoking, Food, and Drugs

  • Alcohol is strictly prohibited inside the facility. Do not bring, consume, or be visibly impaired by alcohol on the premises. PSL reserves the right to end any session immediately and without refund if alcohol is detected or if any person appears impaired.
  • No smoking, vaping, or use of cannabis anywhere inside the facility or in the building common areas.
  • You may bring personal food and non-alcoholic beverages. You are responsible for removing all personal trash, bottles, and containers at the end of your session.
  • Operating a simulator, golf club, or door access while impaired by any substance is strictly prohibited.
  • If impairment contributes to any injury or damage, you accept full responsibility and waive any claim against the Released Parties.

Property and Cleanliness

  • Leave the bay in the condition you found it. Collect all balls, tees, and personal items before leaving.
  • Do not move, unplug, or reconfigure any equipment, cables, or settings beyond what is required for normal play.
  • Report any malfunction, damage, or safety concern immediately via the contact information provided in your booking confirmation.

Damage

  • You are fully responsible for any damage you or your Guests cause to the facility, equipment, or screens, whether intentional, negligent, or accidental. You agree to pay the full cost of repair or replacement, which may include but is not limited to: impact screens ($1,500–$3,500 per screen), projectors ($2,000–$4,000 per unit), launch monitors ($8,000–$18,000 per unit), flooring, and structural damage.
  • PSL may charge the payment method on your AlbaPlay account for damage costs, or pursue collection through other legal means.

Monitoring

  • The facility is monitored by video surveillance during operating hours and outside of them for safety and security purposes. By entering the facility, you consent to being recorded. Footage may be retained and used for security, investigation, insurance, or legal purposes.
  • Audio is not recorded inside bays.

7. Medical Fitness and Assumption

You represent that you are physically able to participate in golf simulator activities. If you have any medical condition that could be aggravated by physical activity, including but not limited to heart conditions, back or joint problems, pregnancy, vertigo, seizure disorders, or recent surgery, you should consult a physician before using the facility. You assume full responsibility for any medical consequences of your participation.

In the event of a medical emergency, call 911 immediately. Do not wait for staff — no staff are on site.

8. No Refunds for Rule Violations

Sessions ended early due to violation of these rules, unsafe behavior, or damage to the facility are not refundable. PSL reserves the right to deny access, terminate memberships, or ban individuals from future bookings at its sole discretion, with or without refund.

9. Cancellations and Refunds

Cancellation and refund policies are set out in your booking terms on AlbaPlay. In general, cancellations must be made at least [number] hours in advance for a refund. No-shows and late cancellations are not refundable.

10. Photo, Video, and Marketing Consent

Occasionally, PSL may use screenshots of simulator performance (such as leaderboard data or longest-drive data) for social media and marketing purposes. No personal identifying information will be used without your separate explicit consent. If you do not wish to be included, email us at the address below and we will exclude your data from marketing use.

11. Severability

If any portion of this agreement is found by a court to be unenforceable, the remaining portions will continue in full force and effect.

12. Governing Law and Jurisdiction

This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from this agreement will be resolved in the courts of Ontario, with venue in the judicial district of York Region.

13. Amendments

PSL may amend this agreement from time to time. You will be required to review and re-accept the updated agreement when making new bookings. The current version is the one in effect on the date of your booking.

14. Entire Agreement

This document, together with the AlbaPlay Terms of Purchase, constitutes the entire agreement between you and PSL regarding your use of the facility.
